Terms and Conditions

These terms govern your use of DearlyGifted at dearlygifted.com, including personalized song orders, payments, delivery, revisions, refunds, and usage rights.

1. Acceptance of Terms

By accessing or using DearlyGifted ("we", "us", "our"), you agree to these Terms and Conditions. If you do not agree, please do not use our website or place an order.

2. About Our Service

DearlyGifted provides personalized digital songs. Each song is created using information you submit in our quiz — names, relationships, memories, tone, and other details you choose to share.

  • Personalized lyrics tailored to your story
  • A custom audio file with music and vocals
  • Digital delivery via email and private download page
  • Download access for 90 days from delivery (contact us if you need a fresh link)

3. Customer Responsibilities

When you place an order, you agree to:

  • Provide accurate names, pronunciations, memories, relationship details, and any other information needed for your song
  • Have permission to submit personal details about anyone mentioned in your order, including names, stories, and relationship information
  • Review your quiz answers carefully before checkout — they form the basis of your song

We are not responsible for errors in a delivered song that result from inaccurate, incomplete, or unauthorized information you provide.

4. How We Create Your Song

Your story becomes the lyrics. AI brings it to life with music and vocals — we never clone real voices. To fulfil your order, we may use artificial intelligence, software, production tools, and automated or assisted music and vocal generation. We do not clone real people's voices without authorization.

Our production process may combine AI-assisted writing and audio generation with human review, editing, and quality checks. Methods and tools may change over time as we improve the service.

5. Pricing and Payment

Each order is a one-time purchase. There is no subscription, membership, or automatic renewal. Payment is required before song production begins.

Prices are shown in Indian Rupees (INR) for customers in India, or in US Dollars (USD) for international customers.

  • India: Razorpay (UPI, debit/credit cards, net banking)
  • International: Dodo Payments (cards and global payment methods)
  • You agree to pay the price displayed at checkout, including any add-ons selected

Payment information is processed by our payment partners. DearlyGifted does not store your full card details. International payments are handled by Dodo Payments under Dodo's buyer and merchant terms.

6. Delivery Policy

After successful payment, production begins and your song is delivered digitally:

  • Standard delivery: Typically within 24 hours
  • Express / rush delivery (optional add-on): Ready in 1 Hour
  • Delivery method: email notification plus a private download page and secure download link. You can also track progress on our Track Order page.
  • Weekends and holidays: delivery targets are based on business hours and production capacity. Times may extend on weekends, public holidays, or during high demand unless your rush add-on states otherwise.
  • Incorrect email address: if you provide the wrong email, contact support@dearlygifted.com promptly with your order number. We will try to resend delivery to the correct address, but we are not responsible for delays caused by an incorrect email you supplied.
  • Download availability: your private download page and link remain available for up to 90 days after delivery. Download and keep your MP3 during that period.

If we cannot deliver your song within the promised delivery period for your selected service level, you may request either an updated delivery estimate or a refund by emailing support@dearlygifted.com.

7. Revision Policy

Because every song is custom-made, we want you to be happy with the result. If something is not right with your delivered song, email support@dearlygifted.com within 30 days of delivery with your order number and a clear description of what you would like changed.

Revisions included: we typically include one revision per order where appropriate. Additional revisions are at our discretion.

What counts as a revision: changes that stay within your original brief — for example correcting a name or pronunciation we got wrong, adjusting tone or wording, or fixing a factual detail from your submitted memories.

What counts as a new song: a fundamentally different concept, new recipient, new occasion, wholesale genre change, new singer direction, or a request that bears little relation to your original quiz answers. These are treated as a new order, not a free revision.

  • Changing genre, singer style, or entire lyrical direction after production may be declined or treated as a new order
  • Revision requests must be submitted within 30 days of delivery
  • Expected revision turnaround is typically 24–48 hours, depending on complexity and queue volume

8. Refund and Order Cancellation Policy

Every song is custom-made to your order. The rules below explain when refunds and cancellations are available. We also stand behind delivered orders with a 100% Money Back Guarantee where stated below.

Cancellation before production begins: orders may be cancelled for a full refund if you contact us before production has started. Email support@dearlygifted.com as soon as possible with your order number.

Cancellation after production begins: once production has started, cancellation and refund requests are considered individually because the product is customised specifically for you. Refunds are generally not available after production begins, except where required by law, where we cannot deliver, or where we agree otherwise at our discretion.

Failure to deliver: if DearlyGifted cannot deliver your song within the promised delivery period for your selected service level, you may request either an updated delivery date or a refund.

After delivery — technical or factual errors: after delivery, we will correct technical issues, incorrect names, pronunciation errors attributable to us, or material deviations from the brief you submitted — usually through a revision or remake. A refund may be offered if we cannot reasonably fix the issue.

After delivery — subjective dissatisfaction: refunds are not normally provided solely because of personal taste where the delivered song substantially follows the information and preferences you submitted. If you are genuinely unhappy, contact us within 30 days and we may offer a revision, remake, or refund at our discretion.

  • Incorrect information submitted by you: we are not obliged to refund orders where the song correctly reflects inaccurate or incomplete information you provided
  • Duplicate payments: if you were charged twice for the same order, contact us with both transaction references and we will investigate and refund the duplicate charge where confirmed
  • Technical failure on our end: if song generation or delivery fails due to a technical issue on our side and we cannot complete your order, you are entitled to a refund
  • Approved refunds are processed to the original payment method within 7–10 business days

Dodo Payments (international orders): Dodo currently allows full or partial refunds to be initiated within 30 days of the transaction, with funds returned to the original payment method. Because customers pay before the customised song exists, Dodo's buyer terms may treat certain orders similarly to pre-orders. We process refunds in line with both these Terms and applicable payment-processor rules.

9. Intellectual Property and Song Usage

What you receive: when your order is delivered, you receive a personal, non-exclusive, non-transferable licence to download, keep, and use your song for personal, non-commercial purposes.

  • Personal use: yes — gifts, private celebrations, and sharing with friends and family
  • Social media: yes for personal, non-commercial sharing — for example posting a gift video to friends and family
  • Commercial use: requires our prior written permission — including advertising, resale, branded content, or use in a product or service you sell
  • Spotify, Apple Music, or other distribution: not included by default. Uploading or monetising the song on streaming platforms requires a separate licence from us
  • Monetised videos: using the song in monetised videos, ads, or sponsored content requires our prior written permission

What you may not do: claim authorship of the underlying composition or production, resell the song file, sublicense it, or use it commercially without our consent.

What DearlyGifted retains: DearlyGifted owns and retains all rights in our website, brand, production methods, prompts, workflows, templates, software, and underlying tools used to create and deliver songs — including copyright in the production process and underlying materials, except for the personal-use licence granted to you in the delivered audio file.

10. Your Content and Submissions

By submitting information for your song, you confirm that you have the right to use the content you provide and that doing so does not violate anyone else's rights. You grant DearlyGifted a licence to use your submissions solely to create, deliver, and support your order.

You retain ownership of the personal stories and information you submit. We do not use your order details to create songs for other customers.

11. Acceptable Content Policy

Custom-song requests can contain sensitive material. You may not use DearlyGifted to request content that is:

  • Hateful, discriminatory, or harassing
  • Threatening or intended to intimidate another person
  • Sexually explicit, or sexual content involving minors
  • Defamatory or falsely damaging to another person's reputation
  • Impersonating another person, celebrity, or public figure without authorization
  • Political manipulation, disinformation, or content designed primarily to deceive someone
  • Copyrighted lyrics, melodies, or other material submitted without permission
  • Celebrity voice imitation or unauthorized voice cloning
  • Private information about another person submitted without their authority or a legitimate reason
  • Otherwise unlawful or intended to facilitate illegal activity

We reserve the right to refuse, cancel, or stop work on any order we reasonably believe violates this policy, applicable law, or our content standards. If we reject a prohibited request before production begins, we will refund your payment. If we must stop work after production has started, refunds are at our discretion except where required by law.

12. Limitation of Liability

DearlyGifted is provided "as is" and "as available". To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of our service.

Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Nothing in these terms limits liability that cannot be excluded under applicable consumer protection law.

13. Governing Law

These terms are governed by applicable law. Mandatory consumer protection laws in your country of residence still apply where they cannot be waived.
